Board of  Zoning Appeals

The Butler County Rural Resolution provides for a five (5) member Board of Zoning Appeals.  The Board holds public hearings to take testimony and decide on appeals of the requirements or interpretation of the Zoning Resolution.  The Board of  Zoning Appeals has the power to rule on three types of zoning appeals: Administrative Reviews, Variances and Conditional Use Applications.   

Variance - The Board has power to grant appeals in specific cases, variances form the requirements of the Zoning Resolution by an applicant who can demonstrate that a hardship will occur unless the variance is granted.

Administrative Review - The Board has power to hear and decide appeals where there is a question concerning a decision of the Zoning Inspector or Zoning Administrator.

Conditional Use - The Board has power to hear and decide Conditional Use applications, which involve land uses that may be appropriate, but due to their more intense nature, require additional regulations to ensure compatibility with the surrounding neighborhood.

The Board of Zoning Appeals hold its meetings on the third Tuesday of every month at 7:00pm in Conference Room 1, on the 1st floor of the Butler County Government Services Center, 315 High Street, Hamilton, Ohio.
